Summary Terms and Conditions:

Prizes: 30,995 spot prizes, to be won during the total promotion period; and one grand prize to win each week during the 4 week promotion period. 1. The promotor of the promotions described within these terms is A.F. Blakemore and Son Ltd, Longacres Industrial Estate, Rose Hill, Willenhall, West Midlands, WV13 2JP (the "Promotor").
2. All entry instructions form part of these terms & conditions of entry (the "Terms & Conditions"). By entering each spot prize promotion (the "Spot Prize Promotion") and/or any of the grand prize draw promotions (the "Grand Prize Promotions" and each a "Grand Prize Promotion") (together the "Promotions") you are deemed to have accepted and agreed to be bound by these Terms & Conditions of entry.
3. Entry into any or all of the Promotions is only open to residents of Great Britain (and is not open to residents of Northern Ireland, the Isle of Man or the Channel Islands) aged 18 or over, excluding employees of the Promoter and anyone professionally associated with any of the Promotions.
Spot Prize Promotion:
4. The Spot Prize Promotion will be live and entries will be accepted between 00.01 GMT on 08 December 2022 and 23:59 GMT on 1 January 2023 (the “Spot Prize Promotion Period”). Entries received before or after the end of the Spot Prize Promotion Period will not be included in the Spot Prize Promotion but may still be charged.
5. To enter the Spot Prize Promotion, you must text the word “XMAS” to 60040 during the Spot Prize Promotion Period. This is not a premium rate number but each text entry is charged at the user’s standard network rate. SMS entry is open throughout the Spot Prize Promotion Period. On entering the Spot Prize Promotion via SMS text message, you will receive a text message back which confirms your entry and confirms whether you have won a Spot Prize. Each valid entry into the Spot Prize Promotion will also give one free entry into the Grand Prize Promotion currently taking place on the date of your text entry to the Spot Prize Promotion and all future Grand Prize Promotions as part of this Promotion.
6. This voucher can only be used at a participating SPAR store as part payment. This voucher cannot be redeemed in conjunction with any other voucher. This offer is subject to availability.
7. Spot Prizes will be allocated via a probability engine provided by i-movo ltd. The probability of winning a prize will be based on a comparison of the number of entries versus the number of prizes available. The Spot Prizes will be evenly split across each day of the Spot Prize Promotion Period.
8. Redeeming your Spot Prize for your preferred choice of the available products will be subject to availability in store. Spot Prize vouchers are only redeemable at participating stores – full details of participating stores can be found on the website www.merrytextmas.co.uk.
Grand Prize Promotion:
9. As part of the Grand Prize Promotion, there will be 4 grand prizes (the "Grand Prizes") to be won; one prize being won each week of the Grand Prize Promotion. The Grand Prize Promotion will be live and entries will be accepted between 00.01 GMT on 08 December 2022 and 23:59 GMT on 1 January 2023 (the "Grand Prize Promotion Period"). Entries received outside of the Grand Prize Promotion Period will not be included. In addition, entries received after the individual promotion periods for each Grand Prize draw (listed below) will not be included in that particular Grand Prize Promotion.
10. In addition to the automatic entry generated by entering the Spot Prize Promotion, you can also enter the Grand Prize Promotions by downloading the SPAR Merry TEXTmas app from the Google Play store, the Apple Store, or by scanning any QR code on any poster for the Merry TEXTmas promotions at a SPAR store. Links to download the Merry TEXTmas app can be found on our website www.merrytextmas.co.uk (the "App"). Please note that an internet connection will be required to download and setup the App and to play the in-App games if additional chances to enter any of the Grand Prize draws are required.
11. Once you have downloaded the App, you will be asked to verify your age, mobile telephone number and your postcode to ensure you meet the eligibility criteria for the Grand Prize Promotions. By providing these initial details, you will receive one free entry into the Grand Prize Promotion that is running at the time of verification, together with any future Grand Prize Promotions which have not yet started. Additional chances to receive additional free entries into the Grand Prize Promotions come from playing the free games Tree-Mendous or Yule Match 3 games on the App, further details of which are provided below.
12. The Grand Prizes available and their respective prize draw periods for each are as follows
a. Grand Prize 1 – A Little Extra Help At Christmas – a cash prize sum, paid to the winner of this prize draw via cheque to the value of £1,130. Each entry to the Grand Prize Draw 1 Promotion during the period between 00.01 GMT on 8 December 2022 and 23:59 GMT on 14 December 2022 ("Grand Prize Draw 1 Period") shall automatically receive one entry into this Grand Prize draw to win Grand Prize 1. Entries received before or after Grand Prize Draw 1 Period will not be included in this prize draw but may still be charged. The draw for this Grand Prize shall take place on 3 January 2023 and winners will be notified no later than 6 January 2023. Provided we can verify all details with the winner, the winner will receive their prize no later than 31 January 2023.
b. Grand Prize 2 – Fuel allowance for a year - a cash prize sum, paid to the winner of this prize draw via cheque to the value of £3,161.50. Each entry to the Grand Prize Draw 2 Promotion during the period between 00.01 GMT on 15 December 2022 and 23:59 GMT on 21 December 2022 (“Grand Prize Draw 2 Period”), together with each valid entry into the Grand Prize Draw 1 Promotion, shall automatically receive one entry into this Grand Prize draw to win Grand Prize 2. Entries received before 00.01 GMT on 8 December 2022 or after the Grand Prize Draw 2 Period will not be included in this prize draw but may still be charged. The draw for this Grand Prize shall take place on 3 January 2023 and winners will be notified no later than 6 January 2023. Provided we can verify all details with the winner, the winner will receive their prize no later than 31 January 2023.
c. Grand Prize 3 – Energy for a Year – a cash prize sum, paid to the winner of this prize draw via cheque to the value of £4,399. Each entry to the Grand Prize Draw 3 Promotion during the period between 00.01 GMT on 22 December 2022 and 23:59 GMT on 28 December 2022 ("Grand Prize Draw 3 Period"), together with each valid entry into the Grand Prize Draw 1 Promotion and the Grand Prize Draw 2 Promotion, shall automatically receive one entry into this Grand Prize draw to win Grand Prize 3. Entries received before 00.01 GMT on 8 December 2022 or after Grand Prize Draw 3 Period will not be included in this prize draw but may still be charged. The draw for this Grand Prize shall take place on 3 January 2023 and winners will be notified no later than 6 January 2023. Provided we can verify all details with the winner, the winner will receive their prize no later than 31 January 2023.
d. Grand Prize 4 – Shopping at SPAR for a Year – a voucher prize, paid to the winner of this prize draw via voucher to the value of £1,406.60 to be used instore at SPAR stores only. Each entry to the Grand Prize Draw 4 Promotion during the period between 00.01 GMT on 29 December 2022 and 23:59 GMT on 1 January 2023 ("Grand Prize Draw 4 Period"), together with each valid entry into the Grand Prize Draw 1 Promotion, Grand Prize Draw 2 Promotion and Grand Prize Draw 3 Promotion shall automatically receive one entry into this Grand Prize draw to win Grand Prize 4. Entries received before 00.01 GMT on 8 December 2022 or after Grand Prize Draw 4 Period will not be included in this prize draw but may still be charged. The draw for this Grand Prize shall take place on 3 January 2023 and winners will be notified no later than 6 January 2023. Provided we can verify all details with the winner, the winner will receive their prize no later than 31 January 2023.
13. Entry into any of the four Grand Prize draws is automatic on your downloading the App, or when a game is played and the various in game criteria are satisfied, depending on the timing of your entry to the Grand Prize Promotion.
14. Additional Grand Prize entry routes can be achieved by successfully playing:
a. the Tree-Mendous treats (AR Tree Game in-store) game on the App, where each day of the Grand Prize Promotion Period, you can play the Tree-Mendous treats game once a day and get an additional Grand Prize entry by successfully completing the game that day. Please follow the instructions within the Tree-Mendous treats game in the App to qualify for an additional daily entry; and
b. the Yule Match 3 (play anywhere tile game) game on the App, where users can earn up to 10 additional entries into the Grand Prize Promotions (one for each group of 10 levels successfully completed) by playing the Yule Match 3 game during the Grand Prize Promotion Period. There are 100 levels in total. Please follow the instructions within the Yule Match 3 treats game in the App to qualify for such additional entry routes.
15. Finally, you can also enter the Grand Prize Promotions online by filling out the necessary online form at www.merrytextmas.co.uk. Upon submission during the Grand Prize Promotion Period, your entry will be counted for the weekly Grand Prize Promotion currently running on the date of submission, and will also gain access to any subsequent Grand Prize Promotions running during the Grand Prize Promotion Period.
16. Grand Prizes will be allocated via a probability engine provided by i-movo ltd. The probability of winning a Grand Prize will be based on a comparison of the number of entries during the promotion period in question versus the number of prizes available during the promotion period in question for each individual Grand Prize draw.
15. If you are lucky enough to win a Grand Prize, we will contact you via SMS text message to arrange delivery of your Grand Prize.
General Terms and Conditions:
18. The Promoter's decision regarding any aspect of the Promotions is final and binding and no correspondence will be entered into about it. The Promoter reserves the right to replace any of the Spot Prizes or Grand Prizes with an alternative Spot Prize or Grand Prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so
19. Winners will be notified by SMS message and, for Spot Prize winners, will be sent a digital voucher via text with a link to a page showing a picture of the prize won, a description and a unique single-use barcode (voucher) to be used in store at the epay, PayPoint or Payzone terminal. Successful entrants in the Spot Prize Promotion can claim their Spot Prize by selecting their choice of Spot Prize from their local SPAR store and taking it to the till to redeem. If a winner does not follow the prize claim instructions on the voucher and claim their Spot Prize within 7 working days of receiving the voucher, the Promoter reserves the right to disqualify that winner and return the Spot Prize to the prize pool, which may be won by another entrant during the Spot Prize Promotion Period.
20. Neither the Spot Prizes nor the Grand Prizes are transferable or exchangeable and cannot be redeemed for any other form of compensation.
21. The Promoter reserves the right to hold void, cancel, suspend or amend any of the Promotions where it becomes necessary to do so.
22. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason.
23. The Promoter is not responsible in the event that a winner fails to receive their prize as a result of having provided inaccurate or incorrect contact details or failing to claim their prize in time.
24. The Promoter may request that the winners participate in publicity arising from any of the Promotions. The winners are under no obligation to participate and may decline this request. Participation is at the winner's discretion and is not a condition of a Spot Prize or Grand Prize acceptance.
25. The Promoter reserves the right to verify the eligibility of entrants. The Promoter may require such information as it considers reasonably necessary for this purpose and a prize may be withheld unless and until the Promoter is satisfied with the verification.
26. As far as permitted by law, the Promoter together with any associated agencies and companies will not be liable for any loss, expense or damage which is suffered or sustained in connection with this Promotion or accepting or using the prize, except for any liability caused by the Promoter's negligence. Your statutory rights are unaffected.
27. An entry must be made directly by an individual acting in their personal capacity. Bulk entries into any of the Promotions from trade, consumer groups or third parties will not be accepted. Incomplete or illegible entries and entries submitted by macros or other automated means together with entries which do not satisfy the requirements of these Terms & Conditions in full will be disqualified and will not be counted. If it becomes apparent that an entrant is using a computer(s) to circumvent this condition by trying to increase their entries into any of the Promotions in a way that is not consistent with the rules of any of the Promotions, that entrant's entries will be disqualified and any prize awarded will be void.
28. The Promoter may refuse to award a prize in the event of any entrant's fraud, dishonesty, breach or non-entitlement under these Terms & Conditions or seek recovery of its value if the Spot Prize or Grand Prize has been awarded.
29. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
30. Any and all personal data provided by you in connection with any of the Promotions will be used solely by the Promoter (or its appointed agents) to: (i) assist with running the Promotions; and/or (ii) conduct analytics to improve the Promoter's promotions, products or services. The Promoter (or its appointed agents) will not contact you for reasons other than the Promotions unless you have provided your express consent. All personal data will be handled in accordance with the Promoter's privacy policy, available here.
31. Except where a winner has requested that their details are not shared, the winners' details (abbreviated names only) will be available for a period of 30 days by emailing SPAR@promotioncustomerservices.com, using "SPAR Winners' List" in the subject line, between 03.01.2023 – 31.01.2023. The Promoter will provide this information to the Advertising Standards Authority on reasonable request.
32. The value of the Grand Prizes are based on the following:
a. Grand Prize 1 – A Little Extra Help at Christmas – the value of this prize is based on statistics provided by a YouGov poll, as analysed by Finder as published on 5 September 2022 (https://www.finder.com/uk/christmas-shopping-statistics#how-much-could-christmas-cost-in-2022).
b. Grand Prize 2 – Transport for a Year – the value of this prize is based on Office of National Statistics' data for an average family's spending in the UK between April 2020 and March 2021 (Statistics and analysis released on 18 July 2022 at https://www.ons.gov.uk/people population and community/

d. Grand Prize 4 – Shopping at SPAR for a Year – the value of Grand Prize 4 is based on the Association of Convenience Stores which acknowledges (using Lumina 2021 data) that an average person spends £1406.60 per year in convenience stores (page 10 of report: https://www.acs.org.uk/sites/ default/files/ acs_lsr2021_d5_v1_aw_lr_spreads.pdf).
33. These Terms & Conditions are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales.
